FACTS. - Blumenthal contracted with Murray School District for a building project, and sub-contracted the concrete work to CSI. CSI sub-sub-contracted part of the concrete work to CECO. Blumenthal posted a bond, but CSI did not. CECO fully performed its work. Blumenthal paid CSI, but CECO had difficulty getting paid. CECO contacted Blumenthal, who offered to make checks payable jointly to CSI and CECO. CECO told Blumenthal that would not be necessary and it would seek payment from CSI.
